ALPA Canada Welcomes the Introduction of Legislation to Address Bargaining Deficiencies in the Canada Labour Code

Ottawa, Ont.—Today, ALPA Canada president Captain Tim Perry issued the following statement on the introduction of Bill C-58—An Act to amend the Canada Labour Code and the Canada Industrial Relations Board Regulations, 2012.

“Today’s introduction of anti-scab legislation in Parliament is an important moment for Canadian workers. For ALPA Canada members, this will help resolve a long-standing issue encountered during collective bargaining—establishing an agreement on essential services within a defined period under the maintenance of activities process.

The proposed maintenance of activities amendments to the Canada Labour Code (CLC) reflect an ALPA Canada initiative and priorities we put forward during government consultations. The amendments will provide more certainty and stability for our members when it comes to bargaining with our employers, and they will put an end to operators utilizing deficiencies in the CLC to gain leverage by delaying and frustrating the bargaining process.

Under the legislation, negotiating parties will be required to enter into a memorandum of agreement and file it with the Canada Industrial Relations Board (CIRB) and the Minister of Labour no later than 15 days after the notice to bargain.

We are pleased to see that the legislation also establishes a timeline of 90 days for the CIRB to render a resolution when the negotiating parties are at an impasse and fail to come to an agreement.

We applaud the government for introducing this legislation that will ultimately encourage an expedient and fair negotiating process.”
